Terms of Service

These Terms of Service (“Terms”) govern your use of the LocalCocina platform operated by 84 Enterprises LLC. By accessing or using LocalCocina, you agree to be bound by these Terms.

1. Service Description

LocalCocina is a multi-tenant software-as-a-service (SaaS) platform that provides kitchens with online booking, payment processing, customer management, and branded website tools. The platform serves two types of users:

• Shop Owners — businesses that create and manage a kitchen on the platform
• Customers — individuals who book orders through a shop's booking page

2. Account Registration

To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscription Plans and Billing

LocalCocina offers subscription plans for kitchen owners:

• Free Plan — limited features with a 1.5% platform fee on bookings that accept payment
• Pro Plan — $29/month with expanded features and zero platform fees
• Business Plan — $59/month with all features including custom domains

Subscriptions are billed monthly or annually through Stripe. You may cancel your subscription at any time. Upon cancellation, you retain access until the end of your current billing period. No refunds are provided for partial billing periods.

4. Payment Processing

Payment processing for customer bookings is handled through Stripe Connect. Shop owners connect their own Stripe accounts to receive payments directly. 84 Enterprises LLC is not a party to transactions between shops and their customers. We collect platform fees (where applicable) through Stripe's application fee mechanism.

5. Cancellation and Refund Policy

Each kitchen sets its own cancellation and refund policy for customer bookings. LocalCocina facilitates automated refunds based on the shop's configured policy (full refund, partial refund, or no refund based on cancellation timing). Disputes about individual bookings should be directed to the kitchen.

6. SMS and Email Communications

By providing your phone number and consenting to SMS during the booking process, you agree to receive order reminders and booking confirmations via text message. Standard message and data rates may apply. You can opt out at any time by replying STOP to any message. See our SMS Terms for more details.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the platform or servers
• Upload malicious content or code
• Impersonate another person or entity
• Use the platform to send spam or unsolicited communications
• Scrape, crawl, or harvest data from the platform without permission

8. Intellectual Property

LocalCocina, including its design, code, features, and branding, is owned by 84 Enterprises LLC. Shop owners retain ownership of their business content (service descriptions, images, reviews). By uploading content to the platform, you grant us a license to display it as part of your shop's booking page.

9. Data and Privacy

Your use of LocalCocina is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. Shop owners are responsible for complying with applicable privacy laws regarding their customers' data.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any losses resulting from service downtime.

11. Limitation of Liability

To the maximum extent permitted by law, 84 Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data will be handled in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify affected users by email or through the platform. Continued use of the service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
